3. The Personal Information That We Collect or Process

"Personal Information" means information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device, or any information that may personally identify a natural person, as further defined in this Policy.

The types and categories of Personal Information that we may collect or process include:

  • Contact information, including name, email address, phone number, and other contact information you provide us.
  • Device information, including your IP address, device identifiers, operating system and version, and other device information.

If you are a California resident, to access our supplemental California privacy statement, visit our Notice of Collection for California Residents.

We also collect:

  • Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific website feature.
  • Technical information. Technical information includes information about your internet connection and usage details about your interactions with the website, products or services that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with Personal Information so that it directly or indirectly identifies an individual, we treat the combined information as Personal Information.

4. How We Collect Your Personal Information and Other Data

The categories of information collected automatically may include, but are not limited to: (a) details of your visits to our website, such as traffic data, location data, logs, and other communication data, as well as the resources you access and use on the website; (b) information about your computer or other device and internet connection, including your IP address, operating system, browser type, mobile network information, and device identifiers; and (c) metadata and other information associated with files stored on your device. We collect only the information necessary for the purposes disclosed in this Policy and as permitted by law.

This information is collected to help us understand how our Services are used and to improve user experience, in compliance with applicable privacy laws.

We use automatic collection technologies to operate, maintain, and improve our Services, to personalize your experience, to analyze usage and trends, and for security and fraud prevention. You have the right to opt out of certain uses of your information as described in the Your Rights and Choices section of this Policy.

The technologies we and our service providers use for automatic data collection may include, but are not limited to:

  • Cookies (or browser cookies). Cookies are small data files placed on your device that help us recognize you, remember your preferences, and enhance your experience. Where required by law, we will obtain your consent before placing certain cookies. For more information about managing your cookie preferences, including opt-out mechanisms, please see the Your Rights and Choices section of this Policy.

You may exercise your rights by using the mechanisms described in the Your Rights and Choices section or by contacting us at lily@birdwisebookkeeping.com. Please note that some features of the Services may be unavailable if you choose to opt out. We will not discriminate against you for exercising your privacy rights, in accordance with applicable law.

  • Analytics companies.
  • Your device manufacturer.
  • Your internet or mobile service provider.

These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites, apps, platforms, and other online services.

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

From Business Partners and Service Providers

We may receive Personal Information about you from other sources and combine that with information we collect directly from you. For example, we may obtain information about you from service providers that we engage to perform services on our behalf, such as email platform providers, payment processors, and analytics, security and anti-fraud services. We also may receive Personal Information from business partners that we engage to share consumer information with us, including your personal preferences.

You may opt out of receiving promotional communications at any time by following the unsubscribe instructions included in such messages or by emailing lily@birdwisebookkeeping.com with "Opt-Out" in the subject line. Please note that opting out of promotional communications will not affect our ability to send you essential communications regarding other important service-related matters.

7. Disclosure of Your Information

We do not sell Personal Information. We do not exchange, transfer, or otherwise disclose Personal Information to third parties for monetary or other valuable consideration. Any disclosures of Personal Information are made solely for the business purposes described in this Policy and not for sale. 8. Your Rights and Choices About Your Personal Information

This section describes mechanisms you can use to control certain uses and disclosures of your information and rights you may have under state law, depending on where you live.

Advertising, marketing, cookies, and other tracking technologies choices:

  • Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. You can choose whether or not to allow the Services to collect information through other tracking technologies by following the opt-out procedure on your browser. If you disable or refuse cookies or similar tracking files, some Services features may be inaccessible or not function properly. Some browsers include a "Do Not Track" (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described in this Policy.
  • Promotions by the Company. If you do not wish us to use your information to promote our own or third parties' products or services, you can opt out by sending us an email stating your request to lily@birdwisebookkeeping.com.

Location data choices:

You can choose whether or not to allow the Services to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some Services features may become inaccessible or not function properly.

9. Your State Privacy Rights

Depending on your state of residence, you may be entitled to specific rights regarding your Personal Information. These rights, as well as the procedures for exercising them, may differ based on state law. Below, we outline the general rights available and highlight important state-specific differences.

  • Access and Data Portability: You may request confirmation of whether we process your Personal Information and obtain a copy of such information. Where required by state law, we will provide your data in a portable format.
  • Correction: You may request that we correct inaccuracies in your Personal Information, considering the nature of the information and the purposes for which it is processed.
  • Deletion: You may request the deletion of Personal Information we maintain about you, subject to exceptions under applicable law.
  • Opt-Out Rights: You may request that we do not use your Personal Information for targeted advertising, profiling, or sales.

Important: Please note that the scope and availability of these rights vary by state, and there are exceptions where we may not be required to fulfill your request under applicable law.

The following states currently provide, or may in the future provide, residents with specific privacy rights: California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia. Residents of these states may have rights to:

  • Confirm whether we process their Personal Information.
  • Access and delete certain Personal Information.
  • Correct inaccuracies in their Personal Information, considering the nature and purpose of the information (except for residents of Iowa and Utah, where this right may not apply).
  • Request data portability, allowing them to obtain their Personal Information in a portable format.
  • Opt out of certain types of personal data processing, including:
    • Targeted advertising (except for Iowa residents).
    • Sales of Personal Information.
    • Profiling in connection with decisions that produce legal or similarly significant effects (except for Iowa and Utah residents).
  • Limit or require consent for the processing of sensitive Personal Information or the Personal Information of minors under the ages of 18, 17, or 16, as applicable by state law.

To exercise any of these rights, please email us at lily@birdwisebookkeeping.com with "Privacy Rights" in the subject line. We may need to verify your identity before processing your request, and will respond as required by applicable law.

Some browsers and browser extensions support the Global Privacy Control ("GPC"), which can send a signal to opt out of certain types of data processing, including data "sales" as defined under certain laws. When we detect a GPC signal, we will make reasonable efforts to honor your preferences as required by applicable law.

Nevada residents have a limited right to opt out of certain personal data sales. To exercise this right, please email lily@birdwisebookkeeping.com. Please note, however, that we do not currently sell data in a manner that triggers Nevada's opt-out requirements.

California residents may have additional privacy rights. For more information, please review our supplemental California privacy statement by visiting the Notice of Collection for California Residents.

10. Data Security

We employ commercially reasonable administrative, physical, and technical safeguards to protect your Personal Information against accidental loss, destruction, unauthorized access, use, alteration, and disclosure. All Personal Information you provide is stored on secure servers protected by firewalls and other industry-standard security technologies.

The protection of your information also relies on your actions. Please exercise caution when sharing your information in public areas or over unsecured Internet connections, as such disclosures may be accessible to third parties. As such, you consent to the collection, storage, processing, and transfer of your information in and to the United States, including Personal Information, as described above. Please note that our Service Providers may collect, store, process, and transfer information, including Personal Information, in the United States and elsewhere whose laws may materially differ from the jurisdiction in which you reside. When we transfer your information, including Personal Information, we will protect said information as described in this Policy.

We will take all the steps reasonably necessary to ensure that your Personal Information is treated securely and in accordance with this Policy and no transfer of your Personal Information will take place to an organization or a country unless there are adequate controls in place including the security of your data and other Personal Information.
